Terms and Conditions

AGREE that:
The activities offered are subject to the conditions of the environment in which they take place and of the people who participate, so they may undergo changes before or even during the activity (weather, sudden changes in the sea, physical problems of the participants, etc.).
The contract and the responsibility of FRANCISCA DE JUAN MOLINOS exclusively affect the direct work of the company’s technicians and the organisation of the activity.
The client must be aware that he/she is contracting a risky activity, assuming any incident that may occur during the activity.
The client declares that he/she does not suffer from cardiovascular diseases, nor is he/she pregnant, nor does he/she suffer from any other injury that would prevent him/her from carrying out the activity without risk to his/her health, and in the event of the possibility of risk, he/she has consulted his/her doctor.
In case of wearing any prosthesis, glasses or contact lenses, the client assumes the risk that they may be damaged during the activity.
The client undertakes not to be under the influence of alcohol, drugs and/or narcotics, or any medication that may compromise their stability, reflexes, or in any way affect their ability.
Minors must have authorisation or be accompanied by a responsible person. In any case, the company may choose to carry out a previous test and reserves the right of admission. It is compulsory to know how to swim and wear a lifejacket while using the kayak. The use of the kayak will in no case be sporting or competitive. The kayaks are for a maximum of 2 people.
The company will not have any civil, administrative or penal responsibility for the non-compliance of the above.
The person making the reservation must be over 18 years of age and will be responsible for the equipment to be used during the route. They must also be in possession of a National Identity Card or Passport. The contract holder is responsible for the rented equipment.
The rental will be carried out with a guide and the environment and all the instructions previously indicated will be respected at all times. The duration will be as previously contracted, including the transfer of the kayak to the sea.
The client will return the kayak and all the material provided in good working order and in good condition. He/she will be responsible for any damage caused during the rental, due to misuse, not adequate to the above mentioned, as well as for theft or robbery of the same.
The Client expressly undertakes to pay the Lessor the amount of all kinds of fines, judicial and extrajudicial costs arising from improper use, infringements and all kinds of regulations that are directed against the rented object.
Payment shall be made in cash or via the booking page on the internet and for the total amount of the contracted service. The delivery before the end of the contract will not give rise to any kind of credit or refund.
The total amount of the Kayak route service will be paid at the moment of signing the contract. The price includes VAT, civil liability and transfer costs.
In case of prior contracting, a 100% reservation will be made, which will not be refunded if it is not cancelled 48 hours in advance, for reasons attributable to the Client.
Failure to show up at the date and time indicated by the company will imply the obligation of the client to pay the full amount of the reservation.
FRANCISCA DE JUAN MOLINOS reserves the right to suspend the activity in the event of non-compliance with these rules or for any other justified cause, as well as to demand from the client, if applicable, the corresponding compensation for damages that may be attributable to the client.
The Client agrees to protect the interests of the Lessor in the event of an accident, not admitting responsibility or guilt and not abandoning the rented equipment without taking measures to protect and safeguard it.
The Client exonerates FRANCISCA DE JUAN MOLINOS from all responsibility for loss or damage to objects left, stored or transported in the Kayak, either in or on the object of the contract, before, during or after the validity of the contract.
FRANCISCA DE JUAN MOLINOS reserves the right to take photographs, film or record any activity or part of it and to use the results for promotional purposes. By registering, participants of the activity allow their image to appear in advertising media. Members who prefer not to have their image and/or voice used for this purpose must notify us prior to the activity.
The personal data provided by the client will only be for personal use for the purposes of this document.
Upon confirmation of the booking, the customer expressly accepts these General Terms and Conditions in their entirety. In the event that a person registers another person/s, he/she assumes on his/her behalf each and every one of these General Terms and Conditions.
The customer declares to have read and accepted the above conditions.
